The Senior Counsel will support Axia and EnFin, the direct-to-consumer entities that provide residential solar financing and residential solar sales and installations. Day-to-day responsibilities will include customer agreements, new market expansion projects, drafting, negotiation, and review of vendor agreements, responses to regulatory requests, dispute resolution and litigation, and counseling on compliance, risk management, and consumer protection. This position reports to the Assistant General Counsel of HQCA who primarily supports Axia and EnFin. This position will be based out of our Irvine or San Francisco office, with an in-office schedule that is set at the direct manager’s discretion in accordance with the company policies and procedures. Remote options could be considered for exceptional cases.  

Responsibilities

    • Support EnFin and Axia with residential solar financing and residential solar sales and installations;
    • Support EnFin, Axia, and HQCA with their expansion into the TPO space;
    • Assist the Assistant General Counsel in negotiating, drafting, and reviewing various consumer and vendor agreements, including borrower agreements, PPAs and leases, dealer agreements, MSAs, and various commercial finance documents;
    • Support the business, including supervising outside counsel, in various other matters, including:
    • Complaint resolution, compliance, and risk management;
    • Regulatory responses;
    • Research into new statutes and regulations affecting the residential solar industry;
    • Providing guidance on consumer protection laws and regulations, including the TCPA, CCPA, and other telemarketing and data privacy laws;
    • Dispute resolution and litigation;
    • Sales and marketing campaigns.
    • All other duties as assigned by the Assistant General Counsel or other senior management personnel. 

Required Qualifications

    • 5+ years of relevant experience
    • Strong background in commercial contracts and consumer agreements
    • Experience with complaint management, compliance, and risk management strongly preferred
    • Experience with ABS financing, tax equity, or other commercial financing helpful
    • Top law firm training preferred
    • In-house experience preferred
    • Experience in the residential solar industry is strongly preferred
    • Membership in at least one state bar
$164,000 - $208,000 a year
The salary range is required by the California Pay Transparency Act and may differ depending on the location of those candidates hired nationwide. Actual compensation is influenced by a wide array of factors including but not limited to, skill set, education, licenses and certifications, essential job duties & requirements, and the necessary experience relative to the job’s minimum qualifications.
